If you place an order with YouPromote this also indicates your acceptance of these terms and conditions and the terms in the Agreement.

Unless otherwise specified, all material appearing on this site, including the text, site design, logos, graphics, icons and images, photographs, graphics, typefaces and other material (collectively "Content" ) as well as the selection, assembly and arrangement thereof is subject to applicable copyright laws.

Disclaimer for Products Sold

Except as expressly stated herein, YouPromote makes no representation or warranties, either express or implied, of any kind with respect to products sold on this site. In no event shall YouPromote, its directors, officers, employees & any representatives be liable for special, indirect, consequential or punitive damages related to products sold.

Your Account Obligations

You are responsible for maintaining the confidentiality of your password. You agree to immediately notify us of any unauthorized use of your password or account or any other breach of security. YouPromote consider this Registration Information private. The information is kept on a secure server to protect it from outside parties. We use the information only for the limited purposes of processing your orders, for statistical purposes to improve our site, for services to you, to administer our site, and to notify you of products or special offers that may be of interest to you.

Cost of Delivery

Delivery costs within Australia are all calculated based Australia Post or Courier delivery charges.

Payment Methods

Credit Cards: We accept all Visa, MasterCard, Bankcard, Diners Club and American Express. There is no surcharge for using your credit card to make purchases.

Ordering Goods

Any order placed by you in the manner described in this site is an offer by you to purchase a particular product or service for the price (including the delivery and other charges) specified on this site at the time you place your order. You acknowledge that, by placing your order, you are agreeing to pay for and accept delivery of the goods ordered unless you ask us to cancel that order, and we send you written confirmation of the cancellation prior to the goods being dispatched to you.

YouPromote may change the prices published on this website at any time. While every effort has been made to ensure the accuracy of prices and information displayed on YouPromote website, we reserves the right to accept or reject your offer for any reason, including without limitation, the unavailability of any product, an error in the price or the product description posted on this site, or an error in your order. We may require additional verification or information before accepting any order. We only accept orders from Australia.

Changes in Orders

We can change orders once they have been placed. However, we require written notification to modify the order.

If written notification is received BEFORE delivery then the customer will not incur extra costs associated with order modification.

If written notification is received within 14 days AFTER delivery then a delivery charges will be incurred by the customer for the return of the goods. To return the goods you must be issued with a Return Authorization Number (RAN) from YouPromote. No goods returned without a RAN will be accepted.

14 days after delivery any permitted order changes is solely at the discretion of YouPromote and a restocking charge of 15% may be incurred.

Policy of Refund

To cancel your order & receive a refund you must be issued with a Return Authorization Number (RAN) from YouPromote. No goods returned without a RAN will be accepted.

Any faulty or damaged stock received within 14 days will be replaced at no charge.

Any orders received incorrectly through the fault of YouPromote, will be replaced at no charge.

Any orders cancelled prior to delivery will be refunded in the same way the payment was made.

Deposits on Rental Products will not be refunded after delivery.

NO cancellations will be accepted after delivery except:

· If the items have not been removed from the original packaging & received by YouPromote within 14 days from the delivery date.

· The delivery costs back to YouPromote will be incurred by the customer.

If the products have been handled ONLY by certified YouPromote Installers & received by YouPromote within 14 days from the Installation Date. The delivery cost back to YouPromote will be incurred by the customer.

14 days after delivery or installation any permitted refunds is solely at the discretion of YouPromote and a restocking charge of 15% may apply.

Delivery

All orders placed through this website are subject to confirmation and acceptance by YouPromote.

YouPromote or its agent will deliver the goods you order to the address you specify in your order, subject to their availability. Where the goods are not available we will notify you of this as soon as possible. Anyone at the delivery address who receives the goods will be presumed to be authorised to receive the goods.

If there is no one at the delivery address or no one of appropriate age to receive and pay for the order, YouPromote may charge you additional delivery fees.

Title & Risk

Title to the goods purchased on this site does not pass from YouPromote to you until we have received payment in full for the goods. All risk in the goods passes to you upon delivery.

Ownership of Product

Property in the Equipment shall not pass to the Customer until purchase monies are paid in full & YouPromote reserves the right to take possession of and dispose of the Equipment as it sees fit at any time prior to full payment being made by the Customer & the Customer thereby grants permission to YouPromote to enter upon any land or premises where the products are in order to retake possession. We have the right to enter onto you premises without notice or consent in order to recover possession of the Equipment if your scheduled Rent Instalment was not received by us.

Limitation of Liability

YouPromote shall not be liable for any claim, loss or expense of any nature whatsoever which arises on or after the expiration of 14 days from the date of delivery or once the Equipment has been altered, varied or otherwise used after which they shall not be deemed to have been complete or unqualified acceptance of the Equipment. YouPromote will not admit any liability which would exceed the cost of replacement of the subject goods & shall not in any event be liable for any contingent or indirect special or punitive damages arising in any way whatsoever in relation thereto and the buyer acknowledges that this is an express condition and limitation of liability & agrees to limit any claim accordingly. No other term, condition, warranty, representation, agreement or understanding of any nature whatsoever expressed or implied in any way extending to or otherwise relating to or binding on YouPromote in relation to such sale other than these terms which YouPromote agrees in writing to be made or given.

Default

Should the Consumer fail to pay any outstanding amount (such as Rent Instalment) within the agreed terms the Consumer will be responsible for any additional costs associates with the recovery of the outstanding amounts, including but not limited to the cost of a solicitor and any cost incurred by YouPromote’s nominated collection agency.

Warranty

We issue a 2 year manufacturers warranty. This warranty is not valid unless the Equipment is installed or handled by a qualified YouPromote installer.

Accepted Behaviour

It is presumed that you will not replicate or copy this site, break the terms that you have agreed or enter the site other than through public and secure access presented to you as a first time user or a member

Our Rights

YouPromote may elect to electronically monitor areas of the Site and may disclose any Content, records, or electronic communication of any kind (i) to satisfy any law, regulation, or government request;(ii) if such disclosure is necessary or appropriate to operate the Site; or (iii) to protect our rights or property or the rights of the users, our directors, employees, representatives, sponsors, third party providers or licensors. We are not responsible for screening, policing, editing, or monitoring such Content.

YouPromote maintains the right to suspend or terminate access (Yours) to all or some of the Site, without notice, in our sole discretion.

Errors of Information Provided on the Site.

In the event a product is listed at an incorrect price due to an error in information received from our suppliers or due to a data entry (typographical error), YouPromote shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. This will also apply to any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled YouPromote shall issue a credit to your credit card account in the amount of the incorrect price.

Applicable Law

As far as legally possible this Agreement, its terms and conditions and the Use of this Site shall be governed by the laws in existence from time to time in Australia. You agree any claim relating to the Site and our service can only be dealt with in a court in Sydney in the state of New South Wales, Australia.

Termination

These terms are effective even if this Agreement is terminated by either party. Subject to applicable law, we reserve the right to suspend or deny, in our sole discretion, your access to all or any portion of the Site with or without notice. You agree that any termination of your access to the Site may be effected without prior notice, and acknowledge and agree that we may immediately deactivate or delete your registration and all related information and files under your registration and bar any further access to such files or the Site. Further, you agree that we shall not be liable to you or any third-party for any termination of your access to the Site.

Revisions of Terms of Use

YouPromote may revise or amend these Terms of Use at any time at our absolute discretion by posting revised terms. You agree that, in the event that any portion of these Terms of Use is found to be unenforceable, the remainder of these Terms of Use remain in full force and effect. Any revisions will be effective immediately. By continuing to use this site after any revision becomes effective, you agree to be bound by these Terms of Use as so revised. You should therefore periodically visit this page to determine the then current Terms of Use to which you are bound.
